IndiaFilings is one of the largest legal-services platforms in India — in the same league as Vakilsearch and LegalRaasta. They handle company incorporation, trademark filing, GST, FSSAI, and ongoing compliance.

BrandAuditor isn't a competitor — it's the layer above. We help you decide which name to file with IndiaFilings (or any other filing service). Here's the breakdown for founders trying to figure out which one to use first.

What IndiaFilings does

IndiaFilings is a full-service legal compliance platform. Their offerings:

  • Trademark services — TM-A filing, opposition response, renewal (typical pricing ₹6,500–₹12,500 per class including government fees)
  • Company incorporation — Pvt Ltd, LLP, OPC, partnership (₹5,899+ packages)
  • Tax & compliance — GST registration, GST return filing, income tax filing, ROC compliance
  • Licenses — FSSAI, MSME (Udyam), import/export code, professional tax
  • Free trademark search — single-class wordmark lookup against IP India

It's a wide product. They serve mostly post-incorporation compliance, with naming/IP being one stream of many.

The right sequence

For a founder naming a new brand:

  1. BrandAuditor — narrow your shortlist of 5–10 names to 1–2 winners. Catch phonetic conflicts, descriptiveness risk, MCA collisions, taken domains, and social-handle squatting before you commit.
  2. IndiaFilings (or another filing service) — file the TM-A application + government fees on the winner. Add company incorporation, GST, etc., if you're also setting up the entity.

Doing it the other way around — filing on a name first and discovering a conflict later — costs you the ₹4,500–₹9,000 per-class government fee plus the service fee, plus the 4-month wait to get the examination report back saying it was refused.

Common confusions

“IndiaFilings has a free TM search — isn't that enough?”

It's a useful sanity check, but it's a wordmark-only, single-class lookup. It will miss:

  • Phonetic similarity — “Sundara” clears, but “Sundaara” was filed last week and they're indistinguishable in the eyes of the Examiner
  • Marks across other classes — class 32 (beverages) might clear, but a similar mark in class 33 (alcoholic beverages) could still refuse you under cross-class likelihood-of-confusion
  • Pending applications — anything filed but not yet examined

BrandAuditor handles all three by default.

“Why not just go straight to filing?”

Because ~30% of TM-A applications in India are refused at examination (most under §11 likelihood-of-confusion or §9 descriptiveness). Filing on a refused name costs ₹4,500–₹9,000 in non-refundable government fee per class, plus 4 months of waiting to find out. A 60-second BrandAuditor check before filing eliminates the most preventable category of refusal.

Bottom line

IndiaFilings is a strong choice for the filing step — they have scale, attorney coordination, and bundle naming with company incorporation if you need both. BrandAuditor is the diligence layer before you file. Use them in sequence, not in opposition.
